CBF changes statute, and president may have a third term; see details

At an Extraordinary General Assembly held this Friday (8), at the headquarters of the CBF (Brazilian Football Confederation), in Rio de Janeiro, an amendment to the statute was approved to allow the entity’s president a third term.

The previous document provided for only one re-election, for two terms, and now there will be up to two reappointments. The act already benefits the current president, Ednaldo Rodrigues. He could remain in office until 2034.

This possibility was anticipated by Itatiaia on Monday (4).

The change was also extended to state federations and unanimously approved by the 27 presidents present in the Assembly. The meeting was made up only of the federations because it is not an event with an electoral purpose, when the clubs participate because they also vote.

The possibility of a second re-election gives Ednaldo legal certainty that he will be able to participate in the election in 2026, for another four-year term, until 2030.

There was a fear among the president’s allies that his candidacy could be prosecuted if there was an understanding that his election in 2022 should already be considered a re-election, as he had presided over the entity since September 2021.

Another possibility of inclusion in the reform did not go ahead: the creation of a barrier clause preventing presidents of clubs and federations who do not become compatible, that is, resign from their positions one year before the election, from running for president of the CBF. This would make it difficult to form opposition slates.

Ednaldo’s departure

It is pending before the STF (Supreme Federal Court) whether the removal of Ednaldo Rodrigues from the presidency of the CBF, defined on December 7, 2023 by the Court of Justice of Rio de Janeiro, is valid. If confirmed, a new election must be scheduled. Otherwise, Ednaldo will normally serve his term until March 2026.

On January 4, 2024, the , until the case was analyzed by the plenary. The process has already been discussed a few times, the last time on October 9, but each time the decision has been postponed.

The request for reappointment was made by the PCdoB (Communist Party of Brazil). Mendes understood that, as the TJ-RJ’s decision was not recognized, Brazil could be harmed in immediate actions that required the president’s signature, such as Brazil’s registration in the men’s Pre-Olympic Games for the Paris Olympic Games.

The party’s entry into history is made through the call of the CBF general secretary, Alcino Reis Rocha. He was previously affiliated with PCdoB, was National Secretary of Football and Supporter Defense and held other positions in the Ministry of Sports, between 2006 and 2011, together with federal deputy Orlando Silva, also from PCdoB, then Minister of Sports. Both are from Bahia, like Ednaldo.

During the almost 30 days of Ednaldo’s absence, the CBF was under the command of José Perdiz de Jesus, then president of the STJD (Superior Court of Sports Justice). He started the process for the new election, as determined by the TJ-RJ, and two pre-candidates emerged: lawyer Flávio Zveiter, former head of the STJD and former director of the CBF, and Reinaldo Carneiro Bastos, president of the Federation Paulista de Futebol (FPF).

Understand the case

The process that caused Ednaldo Rodrigues’ removal has been active since 2018, on the initiative of the Public Ministry of Rio de Janeiro, still referring to the election of Rogério Caboclo, Ednaldo’s predecessor.

The MP questions the confederation’s statute as being in disagreement with the Pelé Law because it provides different weights for clubs in voting to choose presidents. The directors of the 27 state federations have a weight of 3 in the vote, against a weight of 2 of the 20 clubs in Series A and a weight of 1 of the 20 in B.

In 2021, the court annulled the election of Rogério Caboclo and ordered an intervention in the CBF, appointing Rodolfo Landim, president of , and Reinaldo Carneiro Bastos, as the interveners. This decision was revoked shortly afterwards.

A and the Public Ministry reached an out-of-court agreement and signed a Conduct Adjustment Term (TAC). In the new election, in 2022, Ednaldo Rodrigues, who was acting president, was elected for a full four-year term, until March 2026.

Gustavo Feijó, who was vice-president at the time of Caboclo, called the second instance. The request was that the TAC be annulled, and Ednaldo removed, claiming that the judge of first instance did not have the power to approve the document. This was what was accepted on December 7, 2023 by the TJ-RJ.
