Current candidate for president of -SP, who makes up one of the opposition slates in the election, after he mentioned an accusation of domestic violence from 2010.
At the time, Sica, current vice-president of the entity, was accused by his then wife of having attacked him in the midst of a separation process. She filed a police report, but the case ended up going no further.
On the 17th, David wrote a comment on a Facebook post by lawyer Luiz Flávio Borges D’Urso about the election. “We will never support abusers of women, like Sica. I believe women won’t either.”
David and D’Urso support Caio Augusto Silva dos Santos’ candidacy for president of the entity.
The post led to Sica’s reaction. “The defendant Marcos Antonio David deliberately and without any basis attacked the objective honor of the plaintiff [Sica]accusing him of committing a very serious crime against women, which does not correspond to reality”, says the criminal complaint.
In the reply presented to the Court, David said that he did not intend to offend Sica’s honor, but only to report “facts of public and notorious knowledge, extracted from public documents, published in the mainstream press, which report the plaintiff’s previous behavior”.
“The legal profession cannot comply, crowning as president of the professional body a person with this history, which is considered incompatible with the position of president of the Brazilian Bar Association, São Paulo section”, added David.
In a note, Sica says that the topic is old and has already been explored in the 2018 and 2021 elections for the OAB-SP.
“Once again, my opponents are trying to resurrect this point that has already been overcome to obtain political-electoral gains, with the sole objective of manipulating the scenario for their own benefit. To confront my opponents against this attempt, the only answer is to seek justice to defend integrity of everyone involved”, he declared.
