OAB-SP withdraws trial against Ives Gandra Martins from the agenda

The judgment of an appeal against jurist Ives Gandra Martins at OAB-SP was removed from the agenda and will no longer be voted on this Friday (8). The information was confirmed by the Ethics and Disciplinary Court of the Brazilian Bar Association São Paulo Section (OAB SP).

“The Ethics and Disciplinary Court of the Brazilian Bar Association São Paulo Section (OAB SP) informs that the aforementioned trial session is not on the agenda for next Friday, November 8, 2024, which is public”. Asked about setting a new date, the OAB said that, as it is a confidential process, it does not provide the information.

This is a case of disciplinary representation against the jurist for alleged incitement to a coup d’état, presented by the Brazilian Press Association (ABI) and the National Human Rights Movement (MNDH). In December 2023, the 6th Panel of the OAB-SP Ethics and Disciplinary Court concluded that the jurist did not commit an infraction, however, the applicants appealed the decision.

In a document sent to People’s Gazettethe jurist says he never defended any type of coup d’état. “I have never been in favor of any coup d’état and I have always declared that there would be no risk of it occurring”, he states.

According to Gandra, there was no deadline for the appeal to be judged, but it was based on the elections for a new presidency of the OAB-SP, which will take place on the 21st. The jurist’s daughter, Angela Gandra Martins, is candidate for vice president on the ticket headed by Caio Augusto Silva dos Santos.
