The Court of Justice rejected (ADI) presented by PSOL, PT and PCdoB against the law approved which authorizes the capital of São Paulo to sign a contract with the private sector.
The authors of the action argued that there was an error in the processing of the bill, as well as a lack of popular participation and budgetary and financial impact studies.
The decision of the Special Body of the TJ-SP, taken based on a report by judge Ricardo Dip, states, however, that popular participation took place through nine public hearings, which were transmitted over the internet.
Regarding the , Dip writes that he does not envisage “creating or changing a mandatory expense or even renouncing revenue that would require a budgetary and financial impact study.”
According to him, the authors intend to discuss possible losses that may arise from future concession contracts and that are not achieved by the law approved by the municipal Legislature.
The project was approved by the Chamber in May this year and came into force after the mayor’s sanction ().
