A U.S. federal judge has stayed an election interference charge against President-elect Donald Trump, canceling all future court deadlines while Special Counsel Jack Smith wraps up the case.
U.S. District Court Judge Tanya Chutkan issued the order Friday, shortly after Smith filed a request to stay the proceedings. Smith said he plans to give a presentation on Dec. 2 about what to do about the criminal case now that Trump has been elected president.
Smith’s office said the case will be dismissed because a sitting president cannot be prosecuted under Justice Department policy. In Friday’s presentation, Smith said his office needs “time to evaluate this unprecedented circumstance and determine the appropriate course to pursue in accordance with Department of Justice policy.”

Smith had accused Trump of illegally trying to stay in office after the 2020 election, which he lost to President Joe Biden.
