A group of jurists and lawyers will formalize, this Friday (8) in Brasília, the creation of the Brazilian Institute of Law and Evidentiary Reasoning (IBDRP), which aims to encourage care with the quality of evidence in legal proceedings.
The law of evidence originated in Italy, in the 1990s, under the influence of the jurist and professor Michele Taruffo, a specialist in procedural law.
In short, the proposal is to reduce subjectivism in judicial decisions through dialogue with epistemology, psychology and neurosciences.
The main objective is to avoid the risk of judicial errors.
“Proof of Legal Facts“, written by Taruffo in 1992, was translated into Spanish by Jordi Ferrer Beltrán, director of the Chair of Legal Culture at the Universitat de Girona, in Spain.
Jordi will participate in the launch of the new institute in Brasília.
Vitor Lia de Paula Ramos, doctor in law from the University of Girona (UnivGirona) and professor at PUC-RS, wrote the Portuguese version of “A simple truth“, by Taruffo.
Vitor Lia is a member of several international institutions in the area of evidence law. He is the CEO of IBDRP.
The institute was created in September this year and has 36 members.
He says that the entity will be a plural forum, without formal headquarters. It will count on the contribution of specialists from other areas, such as engineers, experts and medical examiners.
Taruffo wrote that “the subject of proof has the peculiar characteristic of immediately and inevitably sending anyone who wants to have an unreduced vision outside the process, including outside the law.“. (1)
The launch of IBDRP will be preceded by a debate, this Thursday (7), on the topic “Evidentiary Reasoning in Superior Courts – Challenges, Epistemic and Constitutional Commitments”with the participation of minister Sebastião Reis, from the STJ (Superior Court of Justice), and Jordi Ferrer.
In 2022, Sebastião Reis was honored at the STJ with the launch of the book on evidence and constitutionalized criminal proceedings. The work brings together 55 articles by 79 authors, texts dedicated to the minister.
The debate will be mediated by lawyers Anna Maria da Trindade dos Reis and Thiago Turbay.
Anna Maria is president of the Center for the Study of Law Firms (CESA) in the Federal District; Thiago is a criminalist, with a master’s degree from UnivGirona, and president of the IBDRP Council.
In addition to Jordi Ferrer, the following experts will participate in the launch of the institute, with live broadcast on YouTube and Instagram, among others:
Ronald J. Allen – law professor at Northwestern University, Chicago. Graduated in mathematics from Marshall University and law from the University of Michigan. Experienced in the field of evidence, criminal procedures and constitutional laws.
Carmen Vazquez – doctor in law and visiting professor at the University of Girona.
Flavia Carbonell – professor of law at the University of Chile and president of the Chilean Society of Philosophy of Law.
Luca Passanante – professor of civil procedural law at the University of Brescia (Italy). Member of several international procedural law associations, including the Brazilian Institute of Procedural Law.
Gustavo Badaró – full professor of Criminal Procedural Law at USP, where he defended the thesis for the full professor competition on the topic Evidence and Truth in Criminal Procedure. He is a member of several procedural law and criminal law entities.
Vincenzo Ansanelli – professor at the University of Genoa (Italy), with works on the evolution of the civil process.
