Ministers analyze appeal from the former president’s defense so that the sentence imposed by the Court itself can be reviewed
The STF (Supreme Federal Court) has a score of 5 to 2 to maintain the conviction of former president Fernando Collor de Mello at 8 years and 10 months for the crimes of passive corruption and money laundering. The ministers analyze one presented by Collor’s defense to reduce the sentence, determined by the Court itself in 2023.
Moraes, who is the case’s rapporteur, voted for its maintenance. He has been followed, to date, by ministers Edson Fachin, Flávio Dino, Cármen Lúcia and Roberto Barroso, president of the STF.
Ministers Dias Toffoli and , reducing the sentence to 4 years in prison and 80 days fine. They recognized “material error” in the proclamation of the result by the collegiate body.
The trial, which could lead to the former president being arrested, is in the Court’s virtual plenary session and began on November 1st, with an end scheduled for Monday (11.Nov.2024). The case concerns crimes involving BR Distribuidora, a Petrobras subsidiary at the time of the events, which were investigated by Lava Jato.
The defense’s appeal concerns the so-called “declaration embargoes” and makes it possible to clarify any contradictions or omissions in the decision.
In his vote ( – PDF – 146 kb), Moraes states that the issues raised have already been addressed and the objective of the appeal would only be “rediscuss points already decided by the Supreme Court”.
For the minister, as well as for those who followed him in voting, the defense requests “they reproduce mere nonconformity” with the decision already given.
Cristiano Zanin will not vote in the process because he declared himself impeded. The minister did not explain the reason for the impediment, but he has previously acted as a lawyer in cases involving the operation.
In addition to the former president, two other defendants were also convicted: Pedro Paulo Bergamaschi de Leoni Ramos and Luis Pereira Duarte de Amorim. Everyone filed appeals.
