The judge of the Supreme Court Ángel Luis Hurtado, instructor of the , has now restricted to seven days the period in which the analysis of the Civil Guard must focus on the information intercepted in the office of Álvaro García Ortiz during the search carried out on the 29th. of October. In the order that he issued that day to order the entry of the Central Operational Unit (UCO) of the Civil Guard, the judge (from March 8 to the day of the search), but in a resolution signed this Friday, Hurtado establishes that the analysis expert “is limited” to the dates that cover March 8 to 14, 2024, both inclusive.
Hurtado is investigating García Ortiz and the provincial chief prosecutor of Madrid, Pilar Rodríguez, for the alleged leak of an email sent to the Prosecutor’s Office by the lawyer of , partner of the Madrid president, Isabel Díaz Ayuso, and accused of tax fraud. As soon as the investigation was opened, the instructor ordered the UCO to search the offices of both prosecutors and intervene all their computer and telematic devices. In the case of the attorney general, the operation lasted almost 11 hours, during which the agents cloned all the content stored on his computers, mobile phones and tablet, information that the Civil Guard now has to analyze to look for signs of the leak. that the Supreme Court is investigating.
The order by which the entry and search was ordered did not specify the dates that the analysis of the seized information should cover, except in the case of emails, for which the judge . The start date coincides with the day that the provincial chief prosecutor addressed the prosecutor in charge of investigating González Amador, Julián Salto, to send her a copy of the entire file related “to the partner of the president of the Community of Madrid ”. But by setting the final date on the day of registration, the intercepted emails include messages much later than the days on which the investigation focuses, and may even include emails from García Ortiz related to the case that the Supreme Court has opened against him and his defense strategy. The instructor’s order to limit the exam comes after the Prosecutor’s Office appealed this week to the Criminal Court against the entry and search order and warned, among other things, that the information required by the judge spanned almost eight months “without any explanation.” ”.
The new range now set covers from the day that prosecutor Salto sent the case file to his superiors until March 14, the date on which the Madrid Provincial Prosecutor’s Office published a press release with which it sought to deny the hoax that Hours earlier, Díaz Ayuso’s entourage had launched, according to which the Prosecutor’s Office had offered González Amador an agreement by email to confess his crimes, but had later withdrawn it “by orders from above”, in reference, supposedly, to Garcia Ortiz. The note sent by the public ministry revealed that, in reality, it had been the defense of Díaz Ayuso’s partner who had offered an agreement to the Prosecutor’s Office to avoid jail.
This statement is at the origin of the case opened against García Ortiz because González Amador took that letter to court for an alleged revelation of secrets. The Supreme Court, however, concluded that the note did not reveal any personal information that was not already publicly known, but the court decided to continue with the investigation considering that what could be criminal is the leak of the email sent by the couple. the Madrid president to the Prosecutor’s Office seeking an agreement, which several media published on March 13.
