Minister Gilmar Mendes, of the STF (Supreme Federal Court), released this Tuesday (29) the requests for freedom from former player Robinho for trial. The judge included the case in the virtual plenary session next month, on November 15th and 26th.

The former Milan and dos Santos athlete has been in Tremembé prison, in the interior of São Paulo, since March. In Brazil, he is serving the nine-year prison sentence imposed on him by the Italian courts on charges of gang rape.

The analysis of the case began in September, but was interrupted due to a request from Gilmar Mendes.

The rapporteur of the request is Minister Luiz Fux, who voted against Robinho’s habeas corpus because he understood that the STJ (Superior Court of Justice) did not violate “constitutional, legal or international treaty standards, characterizing illegal coercion or violence against freedom of the patient’s mobility, nor violation of the rules of jurisdictional jurisdiction”.

The former player, who played for the Brazilian team at the 2010 World Cup, is in prison as ordered by the STJ. By 9 votes to 2, the ministers validated Italy’s sentence. He has always denied having committed any crime.

The case occurred in 2013, and the victim was a young Albanian, in a nightclub in Milan. The first instance conviction took place in 2017. The former athlete expressed hope that he would achieve a quick reversal of the prison sentence. Fux has already denied an injunction request (provisional decision) at the HC.

The case became a documentary series, produced by Globo, and which is scheduled to premiere this Wednesday (30), on Globoplay.
