Vice-president of the Superior Electoral Court (TSE), minister Nunes Marques forwarded to the Electoral Attorney General’s Office (PGE) the analysis of the federal deputy (PSOL-SP) against the governor of São Paulo, Tarcísio de Freitas (Republicans).
On October 27, the day of voting in the second round of the election for the Mayor of São Paulo, Tarcísio said that the criminal faction (PCC) — the deputy was defeated in the dispute with (MDB), re-elected mayor of São Paulo.
Nunes Marques’ order is dated November 5th. PGE was notified on November 7th, last Thursday. After a statement from the Electoral Prosecutor’s Office, the minister must decide whether or not to proceed with the criminal report.
In addition to the governor, the mayor is also the target of the action — Tarcísio and Nunes were together when the statement was made. Boulos’ defense argued that both were wearing stickers with the mayor’s ballot box number, in a “coordinated action with the aim of influencing the electorate”.

For the deputy’s defenders, a conduct prohibited in the Electoral Code was carried out, due to the “disclosure of facts known to be untrue during the electoral campaign”, highlighting “the high harmful potential of the conduct, given the importance of the position of the author of the interview [Tarcísio] and the enormous repercussion in the media”.
After the governor’s statement, the Regional Electoral Court of São Paulo (TRE-SP) said it had received “no intelligence report nor any official information about this specific case”.
The Public Security Secretariat, of the Tarcísio government, said at the time that “the Military Police Intelligence System intercepted the circulation of messages attributed to a criminal faction determining the choice of candidates for mayor in the municipalities of Sumaré, Santos and Capital” and that “the Civil Police investigates the origin of the messages”.
Boulos’ lawyers want a police investigation to be opened or a complaint filed.
A CNN contacted the São Paulo government so that Tarcísio could comment on the progress of the crime news. There has been no return yet.
The governor did not speak on the topic after the statement on October 27th. Allies of Tarcísio, according to the investigation CNN at the time, they minimized the impact of the speech.
According to them, the decision to disclose this information came from the governor himself. The interlocutors also pointed out that the governor during the investigation by the Electoral Court.
