Federal deputy Nikolas Ferreira (PL-MG) published a video on his social networks in which he proposes an open debate on the proposed amendment to the Constitution (PEC) that aims to end the six-day working day and one day off , known as 6×1 scale. Authored by deputy Erika Hilton (Psol-SP), the PEC – not yet registered – proposes that a 4×3 scale be adopted, with four days of work and three days of rest.
According to the deputy, in addition to proposing an unrealistic solution that does not consider market rules, the PEC also contains a “bizarre” error, as it proposes a working day of up to eight hours a day, four days a week – which is equivalent to a total of 32 hours per week. However, the PEC text speaks of a working day that does not exceed 36 hours per week.
HAS People’s Gazetterepresentative Erika Hilton’s office stated that the 36 hours per week correspond to the limit that a worker could work each week. In other words, in addition to the regular 32 hours per week, the proposal already includes possible overtime.
“It’s a ceiling, something that could not be exceeded with the use of time banks or overtime,” the parliamentarian’s office said in a statement.
Today, according to article 7 of the Federal Constitution, the working day must not exceed eight hours a day and 44 hours a week. The article also provides for a weekly rest period, preferably on Sundays, and provides compensation for working hours and a reduction in working hours “by agreement or collective labor agreement”.
In the video, Nikolas also states that the 6×1 working day is a complex topic, which deserves in-depth debate and that it is necessary to consider the economic impacts of the measure for workers and companies. The parliamentarian assesses that, as it stands, the proposal will increase rates of informality, unemployment and inflation, in addition to reducing productivity.
As it is a PEC, the proposal needs the signature of a third of the deputies – 171 out of 513 – to be filed. Once this stage has been overcome, it must be approved by committees and, in plenary, it requires the votes of three-fifths of the parliamentarians in the Chamber and the Senate, with two rounds of voting in each House. On Monday night (11), the deputy’s office announced to the press that the proposal already had 134 signatures.
