Current candidate for president of , lawyer Leonardo Sica filed a lawsuit against the for removal of content on .
He requests that the company be forced to remove all messages related to a 2010 police report. And “any content” related to it that is “potentially defamatory and distorted”.
That year, Sica, current vice-president of the entity, was accused by his then wife of having assaulted her in the midst of a separation process. She filed a police report, but the case ended up going no further.
In the process filed this Monday (11), Sica also asks that “the sharing of messages with defamatory or untrue content” related to him in private WhatsApp groups and chats be prohibited. And that “the blocking and removal of content already shared” be imposed.
It also wants the necessary data to be provided to identify those responsible and asks that the process be carried out in secrecy.
When contacted, the candidate’s advisor stated that they will not comment on the matter “as it is a process that is being carried out under judicial secrecy”.
The lawyer maintains that adulterated and defamatory content is being propagated through WhatsApp, with his and his ex-wife’s personal data.
In the process, images of messages are reproduced on WhatsApp that mix excerpts about the subject along with other content and additional comments.
The aforementioned report reported that Sica had filed a criminal complaint against the lawyer of one of the opposition parties in the election, after mentioning the accusation of domestic violence.
In a note about the criminal complaint, Sica stated that the topic is old and has already been explored in the 2018 and 2021 elections for the OAB-SP.
“Once again, my opponents are trying to resurrect this point that has already been overcome to obtain political-electoral gains, with the sole objective of manipulating the scenario for their own benefit. To confront my opponents against this attempt, the only answer is to seek justice to defend integrity of everyone involved”, he declared.
In the lawsuit filed against Facebook, he claims that the episode related to the police report was brought to light again “in a decontextualized and defamatory way, in order to generate uncertainty regarding his nature, honor and morality”.
He also says that there is an intention to undermine his candidacy for the presidency of the São Paulo section of the OAB.
“This bulletin reports a discussion between the author [Sica] and his ex-wife, which occurred in 2010, in which there was a disagreement that culminated in a police report. However, the case was duly clarified and did not result in any criminal conviction”, stated in the process.
“The current sharing of this information, without due context, distorts reality, promoting undue social judgment and tarnishing the honor and image of the author, and suggests that Folha de São Paulo itself would have stated that the Author would not be ‘worthy ‘ of being president of OAB/SP”, he adds.
The vice-president of the section also states that the exposure of the data poses a risk to his and his ex-wife’s security, honor and reputation, affecting not only their private lives, but their professional and family relationships.
