Anti-MST project advances in Congress with ruralist support – 11/13/2024 – Power

The CCJ (Public Security Commission) approved this Wednesday (13) a bill that determines that social and popular movements organized in more than three states must acquire legal personality.

The project is part of a package of proposals sponsored by the ruralist caucus that targets the activities of the (Landless Rural Workers Movement).

During the , held in the Chamber last year, right-wing parliamentarians used this argument about the lack of legal personality to attack the movement.

This Wednesday, there were 33 votes in favor and 11 against, in a setback for left-wing parliamentarians, who did not want the issue to move forward. The project is being processed conclusively and, therefore, goes straight to the , without going through the Chamber plenary.

Deputies from the left must present an appeal so that the project can be analyzed by the Chamber plenary.

Authored by deputy Coronel Assis (União Brasil-MT), the proposal was reported to the CCJ by Alfredo Gaspar (União Brasil-AL). It provides that this acquisition of legal personality must occur to “regulate the performance and functioning” of these movements “and civil and criminal liability, when necessary”.

The bill determines that, in the absence of this, members of these movements may be held civilly and criminally liable in cases of crimes “against life or property committed in the name, defense or relationship of said social or popular movement”.

If this responsibility exists, the rule provides that the movement in question will be prohibited for a period of five years from hiring and being hired, using spaces and resources from the direct administration or the Union, states and municipalities “for their own benefit or that of third parties”.

Another project from the package that targets the MST was also on the CCJ’s agenda this Wednesday, but it was not voted on. Authored by deputy Rodolfo Nogueira (PL-MS) and reported to the board by Bia Kicis (PL-DF), the proposal aims to facilitate the identification and accountability of those involved in cases of invasion of private or public properties.

The project creates the National Register of Property Invasions, which will be integrated into the National Public Security Information System (Sinesp) and will provide information on records of invasions of public or private properties.

In this registration, the property’s address, registry status and name of the owners will be identified, in addition to the incident record carried out by the security forces at the time of the invasion with the “qualification of those involved”, which gives room for people’s personal data to be disclosed. (as full name).

The author of the PL, deputy Rodolfo Nogueira (PL-MS), says in his justification that the proposal wants to “preserve public order, protect property rights and guarantee the accountability of those who engage in property invasions”.

“The accurate identification of invaders is essential for the effective application of the law and the prevention of recurrence in this type of illegal activity”, says the deputy.
