CCJ approves special retirement for education professionals

The Constitution, Justice and Citizenship Committee (CCJ) of the Chamber of Deputies approved the admissibility of the Proposed Amendment to the Constitution (PEC) 573/06, which expands the right to special retirement for other basic education professionals, in addition to teachers. The measure, if approved by Congress, could extend special retirement to workers who performed functions in basic education, such as administration, planning, inspection, school supervision and educational guidance.

According to the rapporteur of the proposal, congresswoman Erika Kokay (PT-DF), an agreement was signed with the opposition so that the granting of the special retirement will only be intended for educational counselors. This adjustment, however, will be discussed later, during the analysis by the special commission that will be created to discuss the PEC.

Currently, teachers who work exclusively in teaching early childhood, primary and secondary education are already entitled to a five-year reduction in the age and contribution time requirements for retirement. This benefit is guaranteed to professionals who can demonstrate a contribution period of 30 years for men and 25 years for women.

The PT member presented a favorable opinion and included PECs 14/07, 266/08, 309/08 and 529/10 in the document, which are being processed together. PEC 573/06 was proposed by former deputy professor Raquel Teixeira (GO).

The rapporteur also highlighted that, according to the understanding of the Federal Supreme Court (STF), the role of teaching goes beyond activities in the classroom, covering the preparation of classes, correction of tests, assistance to parents and students, in addition to coordination and pedagogical direction. These activities, according to the STF, are part of the teaching career, as long as they are carried out by career teachers in basic education units, excluding education specialists.

The next steps in processing the PEC include the creation of a special commission that will analyze the proposal in detail. Then, the PEC will need to be approved in two rounds in the Chamber Plenary. For the measure to come into force, Senate approval will still be required.
