Fux orders government to prevent bets with benefit resources

This Tuesday (13), the minister of the Federal Supreme Court (STF), Luiz Fux, ordered the Lula government to adopt “immediate measures” to prevent beneficiaries from assistance programs, such as Bolsa Família and the Continuous Payment Benefit (BPC ), spend money from programs on online betting, known as bets.

Fux’s decision was taken within the scope of discussions on a Direct Action of Unconstitutionality (ADI) proposed by the National Confederation of Commerce in Goods, Services and Tourism (CNC).

In the action, the CNC questions the Bets Law and claims that there are unconstitutional points in the regulation. According to the CNC, these inconsistencies can cause financial losses to Brazilian families due to the high-risk behavior of bettors.

When reporting the action, Fux also ordered the immediate application of the rules set out in a federal government ordinance that prohibits advertising aimed at children and teenagers on betting sites.

Initially, the text of the regulation of bets provides that these rules on advertising will come into force from January 2025.

Although Fux’s determinations take immediate effect, they will still have to be analyzed by the other STF ministers.

Hearings at the STF

The STF has been conducting public hearings on the impacts of betting on society, and the PGR asked on Monday (11) that the Court consider the laws and ordinances that regulate the platforms in the country unconstitutional.

In response to the PGR, Fux said that the analysis of bets will be carried out based on the regulations proposed by the Lula government and approved by Congress.

This Monday (11) and Tuesday (12), Fux conducted a series of hearings to discuss the topic of regulation. Among those participating in the hearings were secretary Regis Dudena, of prizes and betting at the Ministry of Finance, and minister Macaé Evaristo, of Human Rights.
