The minister Luiz Fuxfrom the Federal Supreme Court (STF), prohibited the values of social benefits, such as Bolsa Família and Continuous Payment Benefit (BPC), from being applied to online betting, the so-called “bets”.
The decision also determines the immediate implementation of the regulation that prohibits the advertising of bets that target children and adolescents.
In September, the Central Bank (BC) released a study showing that Bolsa Família beneficiaries spent R$3 billion on bets, via Pix alone, in August this year.

Although the ordinance regulating advertising aimed at children and adolescents came into force in July, the rule defines that the inspection, monitoring and sanctioning rules for non-compliance would be implemented from January 1, 2025.
“It appears that the current scenario of evident insufficient protection, with immediate deleterious effects, especially on children, adolescents and on the family budgets of beneficiaries of assistance programs, constitutes a manifest periculum in mora”, stated the minister in the decision, published this morning Wednesday (13).
“Periculum in mora” is legal jargon that means “danger in delay”.

Fux’s injunction was granted within the scope of actions by the National Confederation of Commerce in Goods, Services and Tourism (CNC), Solidariedade.
In recent days, the Supreme Court held public hearings to hear experts on the topic.
On Tuesday (12), Fux said that regulation is a condition for maintaining online betting, legalized in Brazil in 2018.
