Federal deputy Maurício Marcon (Podemos-RS) launched a proposed amendment to the Constitution (PEC) that allows Brazilian workers to maintain a 44-hour week regime or establish a flexible regime, with a variable number of hours and days, maintaining their rights labor and salaries proportional to the time worked.
The proposal, which is already being called PEC da Alforria, had already collected 70 signatures by the end of Tuesday afternoon (13), 24 hours after being announced by the parliamentarian. It is an alternative to another PEC, which proposes to end the 6×1 journey.
According to Marcon’s proposal, the reduction in working hours must be obtained through “an agreement, collective labor agreement or free direct contractual agreement between employee and employer, including per hour worked, with the provisions of the individual employment contract prevailing over the instruments of collective bargaining”.
On his social networks, Marcon stated that the project “frees Brazilian workers to work as many hours as they wish, with 1×6, 2×5 shifts… with their labor rights guaranteed.”
The parliamentarian also stated that the model is similar to the American one, where according to him “everyone takes care of their own life and the State stops disturbing those who want to work and produce or those who want to take time off more than work”. “Everyone does what they want, simple as that,” he said.
The justification for the PEC states that a “minimum value per hour worked under the flexible working hours regime will be established, calculated in proportion to the national minimum wage or the minimum wage for the category, based on a maximum working day of forty-four hours per week. These devices guarantee that the worker, when opting for an adjusted working day, receives fair and adequate remuneration at the minimum value established by law or by the professional category”.
The PEC also guarantees that legal labor benefits, such as vacations, FGTS, 13th salary and others, are maintained in proportion to the hours actually worked under the flexible regime. “This measure allows the worker to maintain their rights in accordance with the chosen journey”, states the text.

Marcon’s proposal, with six days on and one off, for 4×3, where the employee works four days a week and has three days off. The proposal gained support on the networks and in Congress, where it obtained more than the 171 signatures of deputies necessary for it to be filed, but it is also the target of criticism.
In addition to not presenting studies on the feasibility and effectiveness of the measures it proposes, as the deputy herself assumed during an interview with Globonews, the PEC was described by critics as demagogic, because, according to experts, .
“I defend FREEDOM, whoever wants to work 7 days a week, as many go to Australia or the USA to do, has that right and whoever wants a 5×2, 4×3 or 0x7 job can also make that choice. It’s funny to see adults falling for PSol’s talk, which doesn’t even have one parliamentarian who had a popcorn cart and wants to bring an ‘innovation’ that nowhere in the world exists”, said Marcon.
In a speech in the Chamber plenary, Marcon stated that the PEC that proposes the end of the 6×1 working day will certainly lead to a salary reduction, even though the text provides for the maintenance of salaries. Another point highlighted by the parliamentarian is that, with the reduction in workers’ working hours, companies will have to hire more people to carry out the service, which will lead to higher prices.
Marcon stated that only four countries sought to adopt the 4×3 journey: the United Arab Emirates, only for public employees; Belgium, where there is a 38 to 45 hour week and employees can choose to work up to 10 or 13 hours a day, reducing the journey to 4×3; Iceland, where the system is being tested on 1% of the population, or 3 thousand people; and Scotland, where the government is trying to implement the model with state subsidies.

Since it was launched, the Alforria PEC has already received 70 signatures, according to the Space Liberdade profile on X. Marcon, who republished the information, had already published a list himself earlier, with 63 signatures.

To be filed, a PEC needs the signatures of at least one-third of the deputies – 171 out of 513. Once this stage has been overcome, it must be approved by committees and, in plenary, it needs the votes of three-fifths of the parliamentarians in the Chamber and the Senate, with two rounds of voting in each House.
In his networks, deputy Nikolas Ferreira (PL-MG), stated that he had just signed Marcon’s proposal, in order to give workers a choice about their journey.
“I am not against the end of the 6×1 journey and I will not engage in cheap populism. We want to offer workers the freedom to opt for a flexible regime, where they, together with the employer, define how many hours will be worked and receive payment according to the time dedicated. This model, inspired by the USA, allows workers to adjust their work to their needs, without losing rights. Less bureaucracy, more freedom. That’s what we need – and not sealing projects to play with workers’ feelings”, said the parliamentarian.
