The text includes a provision in the law on the unseizability of family property to exclude from the measure residential property intended for popular housing from social programs and subsidized with the use of budgetary resources from the Union and the National Social Housing Fund.
It also changes the law on the real estate financing system to indicate that the property cannot be taken due to non-payment of the fiduciary alienation financing.
The proposal was designed based on the case of a militant from the Homeless Workers Movement who lived in Feira de Santana (BA) and had her property in the Minha Casa, Minha Vida program seized due to non-payment of the installments.
In the justification, the deputy states that it is important to consider the problems related to . He remembers that, according to legislation, when the financing installments are not paid, the responsible financial agent has the right to execute the debt and repossess the property.
“What needs to be considered is that Brazilian families suffered strong financial impacts due to unemployment and a reduction in the family budget caused mainly after the Pandemic period between 2020 and 2023”, he says.
“The possibility of losing the property, which in the vast majority of cases is the only home that houses the family, creates a horizon of vulnerability for these people”, he continues. “It is the effective risk of homeless families, with nowhere to go, as they have lost their only home, even though it is in the process of paying off.”
