Defeated on the age criteria after drawing with the current president of the Legislative Assembly, Iracema Vale (PSB), in the dispute for command of the House in the next biennium, state deputy Othelino Neto (Solidariedade) is considering taking legal action to contest the election of the opponent and the tiebreaker rule itself.
Iracema is an ally of governor Carlos Brandão (PSB). He is already close to the former governor and current STF minister. He is also the husband of senator Ana Paula Lobato (PSB), .
Last Wednesday (13), Iracema and Othelino received 21 votes in the plenary vote.
The Assembly’s internal regulations determine that, if there is a tie in the election for the Board of Directors, the oldest person will win the dispute. Iracema is 56 years old and Othelino, 49.
Othelino criticizes the criteria and points out alleged irregularities in the election. He claims that there was a meeting shortly after the draw was announced that he did not participate in. “And the other aspect that needs to be evaluated is the issue of the tiebreaker criterion. Although it is written in the regulations, the highest law, in the hierarchy of laws, is the Constitution. So you have to evaluate whether this rule, in fact, is legal. “
The Constitution does not specify how the members of the board of directors of the Chamber of Deputies and the Federal Senate are elected. In the Chamber’s internal regulations, there is a provision that, in the event of a tie, the oldest candidate, among those from the largest number of legislatures, will be elected.
Iracema is in her first term as state deputy, while Othelino is in her fourth term. The state deputy states that the Chamber’s regulations are a good reference.
The parliamentarian says he is considering taking legal action in the next ten days. “I’m here with the lawyers evaluating the paths to follow. We are initially evaluating the protocol here, at the Maranhão Court of Justice”, he highlighted. “They are putting the elements together, the issue of conduct between one vote and another.”
The dispute exposes the . Dino’s allies see non-compliance with agreements signed before the 2022 elections with parties from his base.
