(Bloomberg) – Asian News International (ANI), one of India’s largest news agencies, has sued OpenAI in an Indian court, alleging that the U.S. artificial intelligence company misused its copyrighted news content.
ANI also alleged that OpenAI stored the data, which constitutes a violation of intellectual property rights, while using its content and data to train its Large-Scale Language Model. The news agency is seeking initial compensation of 20 million rupees (about US$236,000), according to its lawyer, Sidhant Kumar.
During a hearing in the Delhi High Court on Tuesday, Amit Sibal told the court that the platform does not have servers in India, nor does model training take place in the country. Therefore, ANI would not have the right to sue the company in an Indian court. Sibal also mentioned that the news agency is currently on OpenAI’s blocklist.

“We build our AI models using publicly available data, in a manner protected by fair use and related principles, and supported by long-standing and widely accepted legal precedents,” OpenAI said in a separate statement.
The case is the first of its kind against the US company in India.
The court accepted the case and stated that the issues related to training large-scale language models are complex and will require the assistance of a subject matter expert. The court will hear the case again on January 28.
