Former player is imprisoned in the Tremembé penitentiary complex

The Federal Supreme Court (STF) formed a majority this Friday to keep Robinho in prison. In a virtual session, Alexandre de Moraes was responsible for the vote that left the score at 6 to 1 to deny habeas corpus to the former player. Four other ministers followed Luiz Fux, rapporteur of the case, and also voted against the athlete’s release: Edson Fachin, Luís Roberto Barroso, Cristiano Zanin and Cármen Lúcia.
Only Gilmar Mendes spoke out in favor of Robinho’s freedom. Only ministers Dias Toffoli, Nunes Marques, André Mendonça and Flávio Dino have not yet voted.
The former player’s lawyers question the legality of the arrest, carried out in March this year after the Superior Court of Justice (STJ) ordered the execution, in Brazilian territory, of the conviction for the crime of rape that the former athlete committed in Italy. The athlete’s representatives also ask that he serve his sentence in freedom until all appeals to appeal the case are concluded.
Robinho was convicted of raping a young Albanian girl, in Italy, in 2013, when he was playing for Milan. The case took place in an Italian nightclub, and five other friends of the former player were also involved. One of them, Roberto Falco, is also in prison. Another four were not tried.
In Italy, Robinho tried to appeal the court decision, but was convicted in all three instances. The last – and definitive – was in 2022. At this time, he had already returned to Brazil. Because of this, the Italian Ministry of Justice made an extradition request to Brazil, that is, for the Government to send the player back to Italy.
As the country does not extradite Brazilian citizens, the Italian court asked that the nine-year prison sentence be served in Brazil. In March of this year, the former player was arrested and has been serving his sentence ever since.
Robinho has been in pavilion 1 of Tremembé Penitentiary II since March this year. In prison, he has a habit of playing football with other inmates and reading. In addition, he has two project classes, with ten modules each, “Eyes on the future” and “Rewriting my story”. He has already completed nine of each.
