A group of 21 deputies from government-based parties filed this Thursday (21) a request to archive the bill that intends to amnesty those involved in the acts of January 8, 2023. The request was presented to the president of the Chamber of Deputies, Arthur Lira (PP-AL), and led by deputy José Guimarães (PT-CE), government leader in the House.
The parliamentarians signing the request represent parties such as PT, PV, PSD, PSB, PSOL, PRD, PCdoB, PDT, PP, União Brasil and Avante.
“The proposal clearly violates the jurisprudence consolidated by the Federal Supreme Court, which rejects the possibility of amnesty for crimes that violate the foundations of the republican pact, even if committed under the pretext of freedom of demonstration and expression”, it says part of the order.
The parliamentarians’ request comes amid investigations by the Federal Police that led to the indictment of 37 people this Thursday (21) on suspicion of being part of a group that intended to carry out a coup d’état after the victory of Luiz Inácio Lula da Silva (PT) in the election of 2022. Among them is former president Jair Bolsonaro (PL), appointed as the mentor of the actions.
The investigations also point to the existence of an alleged plan to kill Lula, vice Geraldo Alckmin and minister Alexandre de Moraes, of the Federal Supreme Court (STF).
PSOL also presented a formal request for archiving, endorsing the government-led movement.
The amnesty project faces growing resistance in Congress, especially after the explosive attacks last week in front of the STF building and in the Chamber parking lot. On the one hand, there is the suspicion that the author acted alone, but the Federal Police see a relationship with the acts of 8/1.
On the other hand, in opposition, deputy Chris Tonietto (PL-RJ) criticized the attempt to archive it. For her, the PT accepts amnesty “when it is democratic and humanitarian”.
“But with families who have suffered for almost 2 years with their loved ones arrested on January 8th with disproportionate sentences, they don’t have an ounce of compassion,” she said, comparing the current situation to the creation of the PT, which, according to her, occurred after a amnesty granted during the military dictatorship.
PL 2,858/2022 provides for judicial pardon for those involved in the acts of 8/1, sentenced by the STF to sentences of up to 17 years for crimes such as armed criminal association, attempted coup d’état and damage to public property.
Meanwhile, the president of the Constitution and Justice Commission, Caroline de Toni (PL-SC), an ally of Bolsonaro, had signaled her intention to discuss the project in committee and in the plenary at the beginning of December. However, the advancement of investigations against the former president and the political strain associated with the acts made the future of the proposal even more uncertain.
