Bolsonaro could face up to 28 years in prison for attempted coup

Former president and 36 other people were indicted for attempted coup d’état, abolition of the democratic state and criminal organization

The former president (PL) could be sentenced to up to 28 years in prison if found guilty of the crimes cited in the (Federal Police) indictment. This Thursday afternoon (November 21, 2024), for involvement in an alleged coup attempt in 2022.

The PF report cites the crimes of coup d’état, violent abolition of the democratic rule of law and criminal organization. The sentences range from 3 to 12 years – if added together, they reach 28 years in prison.

Bolsonaro was indicted for the following crimes:

  • coup d’état: 4 to 12 years in prison;
  • violent abolition of the democratic rule of law: 4 to 8 years in prison;
  • join a criminal organization: 3 to 8 years in prison.

Among those indicted are former Defense Minister General Braga Netto and Lieutenant Colonel Mauro Cid, Bolsonaro’s former aide-de-camp. According to the PF, the indictment reflects the existence of sufficient elements to indicate the direct participation of the former president and Braga Netto and Cid in a plot to prevent the inauguration of the then elected president (PT).

OTHER INDICATIONS

In addition to this, Bolsonaro accumulates two other indictments by the PF. , for criminal association and insertion of false data into the Ministry of Health system. INVESTIGATION

Operation Contragolpe, which arrested 5 people being investigated for the alleged plan, was on Tuesday (Nov 19) and was based, among other documents, on a series of exchanges of messages between military personnel who allegedly hatched a plan to kill Lula, vice Geraldo Alckmin and minister Alexandre de Moraes.

According to the PF, those investigated were structured through a division of tasks, which allowed the corporation to individualize conduct and verify the existence of 6 fronts of action, by the following groups:

  • Center for Disinformation and Attacks on the Electoral System;
  • Unit Responsible for Inciting Military Personnel to Join the Coup d’Etat;
  • Legal Center;
  • Operational Center to Support Coup Actions;
  • Parallel Intelligence Center;
  • Operational Center for Compliance with Coercive Measures.

The evidence was obtained over almost 2 years, through actions such as breaches of telematic, telephone, banking and tax confidentiality, in addition to award-winning collaborations, searches and seizures, among other measures authorized by the Court.

With the delivery of the report to the STF, the PF informed that investigations into the attempted coup d’état and violent abolition of the Democratic Rule of Law in 2022 are closed.

COUNTERCOUP OPERATION

To PF on Tuesday (19.nov) an operation, targeting suspected members of a criminal organization responsible for planning, according to findings, a coup d’état to prevent the elected government from taking office in the 2022 elections.

The agents targeted the so-called “black kids”, a group formed by Special Forces soldiers, and investigate a plan to execute Lula and his deputy, (PSB). Also de Moraes.

5 were shipped and 3 for search and seizure in Rio de Janeiro, Goiás, Amazonas and the Federal District. 15 measures were determined, such as the prohibition of contact between those investigated, the delivery of passports within 24 hours and the suspension of the exercise of public functions.

One of the targets of Operation Countercoup was retired general Mário Fernandes. He was executive secretary of the General Secretariat of the Presidency in Bolsoanro’s government. He was also an advisor in the deputy’s office and former Minister of Health (PL-RJ).

Also targeted by the warrants were lieutenant colonels Hélio Ferreira Lima, Rafael Martins de Oliveira and Rodrigo Bezerra de Azevedo, and federal police officer Wladmir Matos Soares. All were subject to preventive detention and a ban on maintaining contact with other people being investigated, as well as a ban on leaving the country, with the consequent surrender of their respective passports.

Em the PF said that a criminal organization “a high level of technical-military knowledge was used to plan, coordinate and execute illicit actions in the months of November and December 2022”.

The plan was being called “Green and Yellow Dagger” and would run on December 15, 2022.

The planning prepared by those investigated detailed the human and military resources necessary to trigger the actions, using advanced military operational techniques, in addition to the subsequent establishment of an ‘Institutional Crisis Management Office’, to be integrated by the investigated themselves for management. of institutional conflicts arising as a result of the actions”, said the PF.

The Federal Police closed this Thursday (11/21) an investigation that found the existence of a criminal organization that acted in a coordinated manner, in 2022, in an attempt to keep the then President of the Republic in power.

“The final report was forwarded to the Federal Supreme Court with the indictment of 37 people for the crimes of violent abolition of the Democratic Rule of Law, coup d’état and criminal organization.

“The evidence was obtained through various police investigations carried out over almost two years, based on breaches of telematic, telephone, banking, tax confidentiality, award-winning collaboration, searches and seizures, among other measures duly authorized by the Judiciary.

“The investigations showed that those investigated were structured through division of tasks, which allowed the individualization of conduct and the verification of the existence of the following groups:

“a) Center for Disinformation and Attacks on the Electoral System;

“b) Unit Responsible for Inciting Military Personnel to Join the Coup d’Etat;

“c) Legal Center;

“d) Operational Center to Support Coup Actions;

“e) Parallel Intelligence Center;

“f) Operational Center for Compliance with Coercive Measures
