The defense of retired general Mário Fernandes, arrested on Tuesday (19) on suspicion of drafting the (PT), asked for his transfer to Brasília.
Fernandes is detained at the Command of the First Army Division, in Rio de Janeiro. In a petition to the minister this Friday (22), the lawyers claim that the general has a permanent residence in Brasília.
General Mário Fernandes was one of those indicted by the PF in the coup plot investigation on Thursday (21). In addition to him, the corporation indicted former president Jair Bolsonaro (PL) and 35 other people.
Fernandes was executive secretary of the General Secretariat of the Presidency in the Bolsonaro government. According to the PF, he would have prepared the operational plan called “Green and Yellow Dagger”, which included the use of machine guns and explosives and even that of Lula and Moraes.
In Brasília, the Army has some cells in CMP (Planalto Military Command) barracks. If the transfer is authorized by Moraes, Fernandes should be allocated to some unit in the federal capital, similar to the space where former aide-de-camp Mauro Cid was detained.
“The applicant is serving precautionary detention far from home, away from his roots, violating the precepts of the Criminal Executions Law”, says an excerpt from the petition obtained by Sheet.
On the day he was arrested, Fernandes’ defense requested authorization for visits from his wife and two children. The petition has not yet been analyzed by Moraes.
