Accused may have committed military crimes – 11/23/2024 – Panel

Those accused of devising a plan to kill President Luiz Inácio da Silva (PT), the vice president (PSB), and the minister of the STF (Supreme Federal Court), may have committed several military crimes, in addition to violations of the Code Criminal.

Last Tuesday (19), the PF arrested: the reserve general and lieutenant colonels Hélio Ferreira Lima, Rafael Martins de Oliveira and Rodrigo Bezerra de Azevedo. A civilian, federal police officer Wladimir Matos Soares, was also arrested.

“In an attempt to carry out this Tabajara coup and end the democratic rule of law, they went through several sections of the Military Penal Code”, says Flávio Bierrenbach, who was minister of the Superior Military Court (STM) between 2000 and 2009.

Among the possible crimes cited are riot, incitement, violent organization, conspiracy and irregular use of Union assets and resources. The penalties for each vary from 2 to up to 20 years in prison.
According to Bierrenbach, “for criminal purposes [os assassinatos]committed several crimes [os delitos militares]”.

In the case of military crimes, there would need to be action by the Military Public Prosecutor’s Office with the STM. If sentenced to more than two years, the soldier loses his rank and position.
