In the last sessions, the proposal was not voted on due to lack of agreement and the explosion in front of the Federal Supreme Court (STF), which interrupted discussion of the project last week. The Evangelical Parliamentary Front is pushing for the approval of the text, but there is still no consensus among the benches.
Negotiations
The Proposed Amendment to the Constitution (PEC) was presented by deputy Marcelo Crivella (Republicanos-RJ), who is a licensed bishop of the Universal Church of the Kingdom of God (IURD). He works directly in the joints and on Thursday (21) he was at the Ministry of Finance.
Also participating in the meeting were deputy Reginaldo Lopes (PT-MG), senator Eliziane Gama (PSD-MA), deputy Lafayette de Andrada (Republicanos-MG) and the executive secretary of Finance, Dario Durigan.
Among the changes under analysis is a request from the government to detail which goods and services would have guaranteed immunity, without the incidence, for example, of ICMS and the Tax on Industrialized Products (IPI).
CNN found that some of the deputies are against the text as they believe that the debate on the exemption is not appropriate at a time when Congress is still analyzing the regulation of tax reform and is having difficulty defining differentiated and special regimes without increasing the standard rate. .
The rapporteur of the proposal, deputy Dr. Fernando Máximo (União Brasil-RO), believes that the text will be voted on next week. If approved, it will go to the Senate, where it may have Senator Eliziane Gama as rapporteur.
What does the proposal say
Before going to the plenary, the PEC was approved by the Constitution and Justice Commission (CCJ), in September 2023, and by a special commission, in February this year.
The original text also expanded immunity for political parties, but the rapporteur on the special commission withdrew this provision. Fernando Máximo suggested adjustments and presented a replacement, which was unanimously approved.
The Constitution prohibits the collection of taxes from religious entities and temples of any cult, but tax immunity only applies to assets, income and services related to the essential purposes of the entities.
The PEC approved by the special commission prohibits the collection of taxes on goods or services necessary for the formation of assets, the generation of income and the provision of services by religious entities. According to the text, immunity will apply to daycare centers, nursing homes, orphanages, therapeutic communities, monasteries, seminaries and convents linked to religious entities.
Government endorsement
The PEC of the Churches does not face resistance from the government, which seeks to nod to the evangelical electorate and the Legislative bench that has 240 members, one of the largest in Congress.
The text also has the commitment of Mayor Arthur Lira (PP-AL) to guide it. In the week in which it was discussed in the plenary for the first time, Lira participated in a dinner with the evangelical group, where he was honored.
