Burger King was ordered to pay 4,000 euros to an employee humiliated and insulted by the director: “Brazilians should really get it up their ass.”
O Burger King Portugal was ordered to pay 4,000 euros to a shift manager who was insulted and humiliated by his store director in the Algarve.
On different occasions, the superior called “dumb” and “incompetent” to the victim, he threatened her that he would move her store, and forced her to apologize to customers when she considered that they were not being well served.
The victim was of Brazilian nationality and – like him – there were other Brazilians working in that store.
Although the aggressor said, on one occasion, that “the Brazilians should really get kicked in the ass, as they were all armed with clever” and the worker complained about xenophobiaaccording to , the court did not comment directly on this issue.
JN says that the first episode reported in the process occurred in May 2023, when the shift manager caught the attention of a customer who demanded to be served first than others because he was Portuguese, asking the customer not to offend the employee (also Brazilian) who served him.
“I’m going to speak directly to your boss and you’re going to have to apologize to me, you’re incompetent”, replied the customer – who was a friend of the director and was reimbursed.
“It is unjustified and offensive of the author’s dignity that the defendant demanded that he apologize, when it does not appear from the records that he had behaved incorrectly towards the client”, can be read in the ruling of October 25th, cited by JN.
The judges maintain that that worker had reason to feel humiliated and terminate the contract for just cause, considering the behavior of the company “offensive”, which, through its store director, called the worker “incompetent” and “stupid”.
“Although it may be considered that a worker does not perform the work with the quality and quantity required of him, There will be other ways to convey dissatisfaction to you“.
The company was therefore ordered to pay 4,000 euros to the victim.
