Jack Smith guarantees that decision is “not based on the merits or strength of the case” against Donald Trump
Special Counsel Jack Smith admitted that he will drop the criminal case that accuses President-elect Donald Trump of trying to overturn his 2020 electoral defeat, requesting the judge to dismiss the court case.
“The Justice Department’s position is that the Constitution requires this case to be dismissed before the defendant takes office. This result is not based on the merits or strength of the case against the defendant,” Smith wrote in a six-page brief filed with the court.
In the past, President-elect Donald Trump promised to fire Jack Smith as soon as he took office, something that would break the norms established by both parties regarding special counsel investigations.
This process is, however, marked in North American political history. Never had a former US president faced federal criminal charges. Although the election subversion case culminated in a landmark Supreme Court ruling this summer that established that Trump enjoys some presidential immunity from criminal prosecution, Trump’s strategy of delaying the case has ensured that a trial never takes place before November elections.
