President of the TST defends the application of labor reform in old contracts, guaranteeing workers’ acquired rights.
The president of , Aloysio Corrêa da Veiga, expressed his vote in favor of the immediate application of the labor reform in contracts that were already in force since the promulgation of the law in 2017. He argued that Law No. 13,467/2017 should be applied immediately , without this representing a violation of the rights acquired by workers. Veiga highlighted that the new legislation establishes a new set of legal standards, which does not compromise already consolidated individual legal situations. According to him, those who have already obtained favorable decisions in court continue to have their rights guaranteed, regardless of the changes brought about by the reform.
The TST is currently deliberating on the question of whether the new guidelines only apply to contracts signed after the reform was enacted or whether they should also be extended to contracts that were in force at the time. This decision is crucial as it could impact a wide range of employment relationships in the country. The discussion surrounding the application of labor reform reflects the complexity of the current legal scenario and the need to balance the modernization of laws with the protection of workers’ rights.
