Bolsonaro “planned, directed and executed” acts to consummate a coup d’état, says PF

The Federal Police concluded that former president Jair Bolsonaro “planned, directed and executed” acts to abolish the Democratic Rule of Law and consummate a coup d’état. The attempt to remain in power after the electoral defeat in 2022, according to the PF, only failed to materialize “due to circumstances beyond his control”, mainly due to the opposition of the then commander of the Air Force, Brigadier Carlos de Almeida Baptista Junior; from the Army, General Marco Antônio Freire Gomes; and the majority of the Army High Command.

The conclusion is in the final (full) report of the investigation into the alleged attempted coup d’état, released this Tuesday (26) by the Federal Supreme Court (STF). The material, delivered to Minister Alexandre de Moraes last week, has already been forwarded to the Attorney General of the Republic, Paulo Gonet, who is responsible for formulating a complaint about the case. Bolsonaro and 36 other people, including military personnel and former members of his government, were indicted for the crimes of criminal organization, coup d’état and abolition of the Democratic Rule of Law.

In the 884-page document, the PF says that the evidence gathered in the investigation demonstrates that Bolsonaro “planned, acted and had direct and effective control over the executional acts carried out by the criminal organization that aimed to carry out a Coup d’Etat and the Abolition of the Democratic Rule of Law”. It states that, since 2019, the former president has disseminated “the false narrative of the existence of vulnerability and fraud in the country’s electronic voting system”.

According to the PF, there were two objectives in the “narrative” against the polls: “first, not to be interpreted as a possible casuistic act in case of electoral defeat and, second and more relevant, to be used as a basis for the acts that took place after the defeat of then candidate Jair Bolsonaro in the 2022 election”.

The report says that Bolsonaro was involved in the main facts, revealed over the last few months, to prevent the inauguration of President Luiz Inácio Lula da Silva.

The first is the meeting, which took place on July 5, 2022, in which the then president brought together government ministers – Anderson Torres (Justice), Paulo Sérgio Nogueira (Defense), Augusto Heleno (Institutional Security Office), and the Secretary- general of the acting Presidency, Mario Fernandes – so that they could promote and spread “misinformation” about the polls.

The report highlights several statements made by Bolsonaro to his assistants. “The research is exactly right. According to the numbers that are inside the TSE computers,” Bolsonaro said at the meeting, insinuating fraud in the Superior Electoral Court’s investigation. “From now on I want every minister to say what I’m going to say here, and I’m going to show it”, he also said. “The guys are preparing everything, man! For Lula to win in the first round, through fraud. I’ll show you how and why […] There’s no way this guy can win the election by voting. There is no way to win the vote”, he stated. The PF also highlights that, after the defeat to Lula, Bolsonaro and the president of the PL, Valdemar da Costa Neto, would have authorized the presentation, at the TSE, of a representation to contest the result of the second round. The verification request was summarily denied by Alexandre de Moraes, then president of the TSE, and the PL was fined R$22 million.
