The US Justice Department has moved to dismiss the 2020 election interference case against Donald Trump, asking a judge to dismiss the extraordinary federal indictment against the former president whose re-election ensured he would be protected from prosecution in the White House.
Prosecutors under special counsel Jack Smith, who accused Trump of illegally conspiring to interfere with Congress’ certification of his election defeat four years ago, made the request in court on Monday.
Justice Department policy prohibits the prosecution of sitting presidents, forcing Smith to dismiss the case. Trump, who has denied any wrongdoing, said he would fire Smith and order the department to terminate the special counsel’s work if he were reelected to a second term.
