Supremo analyzes 3 new rules for social networks; Facebook, now Meta, filed an appeal in 2017
The (Supreme Federal Court) begins the trial of 3 lawsuits on the new rules for social networks this Wednesday (27.Nov.2024). Among them is responsibility for content published on the platform.

The trial takes place amid the revelation of a Federal Police investigation, which is investigating the planning of one in 2022. Those involved would have used social media to promote “misinformation and attacks on the electoral system”among other things.

The current model for holding platforms responsible for third-party content will be discussed and in which situations companies may suffer sanctions for illegal content published by their users.
Two of the actions evaluated are directly related to article 19 of the Marco Civil da Internet, which talks about “liability for damages resulting from content generated by third parties” only when a platform fails to comply with a court order for inappropriate content to be removed.
Last week, during an event in Mato Grosso, the STF minister said that network regulation was necessary for the return of a “democratic normality in Brazil”. He declared that “There has never been any industry in the history of humanity that affects many people and has not been regulated”.
On the date, Moraes said: “Is it social media’s fault? No, they don’t think. Those who think are the humans behind social networks, who, without any transparency of the algorithms, aim to captivate and brainwash people, generating this environment of hate”.
The trial takes place amid the investigation’s revelations that there was planning for a coup d’état in 2022. Those involved would have used social media to, among other things, promote “misinformation and attacks on the electoral system”.
