He informed the (Supreme Federal Court) this Wednesday (27) of the content of the new agreement and requested the release of the funds, suspended since August.
In the request sent to the action’s rapporteur, minister, lawyers from and from state that the suspension of individual and bench amendments are “causing serious harm to third parties in good faith”.
“It must be added that there are works and services already carried out, but for which payment has been suspended, causing serious losses to third parties in good faith. There are also works and services paralyzed due to suspension of payments, causing losses to individuals and public interest”, says an excerpt from one of the documents.
“Given the proximity of the end of the financial year, a situation of danger of reverse delay has arisen, notably in view of the amounts already committed, which is why the full reestablishment of the execution of individual and bench tax amendments is required.”
Repeating the dribble given previously, Congress also highlighted that committee amendments are “collegiate” and approved publicly by the permanent committees of both Houses, recorded “in the minutes of the meetings”.
This modality was boosted by the Legislature with the . In theory, distribution is discussed by thematic committees, but in practice, influential deputies and senators choose where the money will be allocated without being identified. There is no record of the congressmen in the minutes either.
The lack of transparency regarding the allocation of this type of amendment, which exceeds R$15.5 billion this year, was the main reason used by Dino for , on August 1st.

To try to demonstrate progress to the Supreme Court, the Legislature also sent the minister a standard letter that was sent to all federal deputies and senators in which the presidents ask them to inform how the money from the extinct rapporteur amendments (called in technical jargon RP9 ) were spent between 2020 and 2022.
Dino awaits information from the Chamber and the Senate on the new transparency measures to resume discussion of the issue and forward the process to the Supreme Court plenary (instead of deciding alone).
