The ministers of the (Federal Supreme Court) took advantage of the beginning of the trial of excerpts from this Wednesday (27) to complain about the existence of false profiles in their names. , for example, stated that there are dozens of accounts with his name, all of them critical of the magistrate.
“The platforms make it difficult and almost ignore you when you want to remove a fake profile of yours. I don’t have Instagram, I don’t have it. And I have about 20 profiles and I have to keep chasing it,” he said.
According to Moraes, there would be no reason for difficulty in the matter. “It’s so obvious that the profile is not mine. Because the profile is just criticizing me. It would be something surreal. And the platform, to remove it, has to notify you, and it doesn’t remove it. The difficulty of proving that it’s not you is much more difficult than opening a false profile”, said Moraes.
Minister Cármen Lúcia, president of the TSE (Superior Electoral Court), also said that profiles were created as if they were hers, even with the wrong spelling of her name. “They still say Cármen Lúcia Official. I don’t have Official as my last name, with a series of errors,” he said. The minister also highlighted how the practice harms the dispute in municipal elections.
The ministers have not yet voted on the case. In the debate, the court will analyze, among other topics, the possibility of holding social media platforms responsible for third-party content.
The debate began after the first oral argument, made by Facebook representative, José Rollemberg Leite. Finally, he stated that the complaints must be under analysis by the company.
At the end of the defense’s speech, President Luís Roberto Barroso asked for clarifications. “I would like to ask about not removing the fake profile. I don’t have a Facebook account so that could be elementary. Can a person who opens an account close it later? Why would someone, being able to close it, ask for it to be closed by the Facebook? I’m trying to understand the logic,” he asked.
José Rollemberg Leite stated that this difficulty has been overcome. “More than 98% of this type of notification is automatically removed, and the residual number, after notification, is gradually reduced. Reaching court is the absolute exception,” he said.
From then on, Moraes questioned the answer. Finally, he added: “taking advantage of this change in procedure, the removal of all my fake profiles is authorized, without a court decision. Barroso and Dias Toffoli joined him.
