The family suspected of harassing the minister of the (Federal Supreme Court) and family members at the airport expressed to the court their intention to make a retraction in order to end the legal process.
In the document sent to the STF, signed on the 18th, Roberto Mantovani Filho, Andreia Munarão and Alex Zanata Bignotto requested the presence of Alexandre de Moraes and his family to make a formal apology.
The three were denounced on charges of insult and slander. Mantovani was also accused of royal libel.
If the minister accepts the formal request for retraction, the criminal proceedings can be closed — the three accused are trying to eliminate any punishment provided for by law.
captured at Rome International Airport. The OAB even declared itself in favor of providing “all copies necessary for professional practice”.
The minister, rapporteur of the case, stated in August that he was trying to re-judge the issue “which has already been decided and confirmed”.
Toffoli removed the confidentiality of the process in October 2023, but images of the confusion were not released.
At the time, the minister said that the video showed people who were not involved in the case, including minors. “No relation to the fact investigated, therefore, their rights to image and privacy must be preserved.”
The case occurred in July 2023. The three accused were approached by the PF as soon as they landed in Brazil and were searched days later, ordered by the then president of the Supreme Court, .
The understanding changed in relation to the first report on the case. Initially, in February this year, delegate Hiroshi de Araújo Sakaki, then responsible for the case, closed the investigation and concluded that Mantovani committed the crime of real insult against Moraes’ son.
The police chief, however, did not indict the businessman, that is, he did not formally attribute the crime to him. The investigator’s argument was that there would be a normative instruction from the PF that prohibits indictment for a crime of lesser offensive potential, with a maximum penalty of two years.
The police officer also argued the need for extraterritoriality of criminal law — that is, for Brazilian law to apply to episodes that occurred abroad. For this, the crime should be “included among those for which Brazilian law authorizes extradition”, which is not the case with real insult.
Subsequently, the (Attorney General’s Office) spoke out against the delegate’s understanding. Minister Dias Toffoli then ordered the PF to continue the investigation.
The case was under the responsibility of delegate Thiago Severo de Rezende, from the Police Intelligence Directorate, who changed his position in relation to his predecessor. The trio was indicted by the Public Ministry in July.
