Under pressure, Dino says that the work done by the STF is not “activism”

The speech comes one day after Congress asked the STF to release payment for the tax amendments, suspended since August.

The minister of the STF (Supreme Federal Court) said that the work carried out by the Court is not “activism”, but rather guided by “roles defined by the Federal Constitution”. The minister’s statement comes one day after the Chamber of Deputies and the Senate for him to authorize the payment of amendments from congressmen, since august.

SUSPENSION OF AMENDMENTS

In August 2024, Flávio Dino ordered the suspension of mandatory amendments (those that are mandatory) of deputies and senators until the National Congress formulates rules that provide more transparency and traceability for the transfer of resources.

In a preliminary analysis of the request, the minister understood that it is unconstitutional to execute amendments that do not comply with technical criteria of “efficiency, transparency and traceability”. As it is a monocratic decision, Dino’s determination will still be endorsed in plenary.

According to the judge, mandatory amendments must be executed in accordance with the terms and “limits of the legal order”, and not stay “under the absolute freedom of the parliamentarian who authored the amendment”.

REQUEST FROM CONGRESS

The Chamber of Deputies and the Senate sent petitions to the STF on Wednesday night (Nov 27) asking Minister Flávio Dino to authorize the payment of congressmen’s amendments, suspended since August. Congress justifies that it is complying with the rules of transparency in the execution of funds, required by the magistrate to release the transfers.

The documents were signed by the attorneys general of both Houses. The Legislature declares that the conditions imposed by Dino were also met with the complementary law sanctioned by President Luiz Inácio Lula da Silva (PT).

With these measures, it is observed that the formal and material requirements of the Court’s decisions regarding the parliamentary amendments of general rapporteur and committee were met, thus allowing the reestablishment of the due execution of the public budget,” the petition states.
