Court gives Enel 15 days to explain blackout in SP and present plan

Decision of the São Paulo Court of Justice accepts request from the São Paulo government; Enel says he will not comment

The TJSP (São Paulo Court of Justice) determined, in a provisional decision, that the energy concessionaire Enel has 15 days to present documents related to the failure in the supply of electricity in the State.

The information was this Saturday (November 30, 2024) by the state government, which is suing the company. Wanted by Poder360Enel said that “does not comment on ongoing legal actions”.

The Court ordered Enel to provide, “in real time”to Arsesp (Public Services Regulatory Agency of the State of São Paulo) information on interruptions in energy supply, number of complaints, teams available for emergency assistance, average service time, number of priority customers affected, such as hospitals and Sabesp ( Basic Sanitation Company of the State of São Paulo), and the waiting time in service queues, among other data.

The decision is an injunction. For now, there remains a 15-day deadline for the concessionaire to present all documents.

In the action, the São Paulo Executive also asks the concessionaire to present a report with the number and location of trees that threaten the electricity supply.

The government of São Paulo requests that the company draw up a vegetation management plan. The document must include a schedule of “concrete actions to mitigate risks involving trees”.

At the beginning of November, the government of São Paulo with the public civil action against Enel in which the company is held responsible for the blackouts in the metropolitan region of São Paulo in November 2023 and October 2024.
