The martial law collected in the South Korean regulatory framework establishes in its article 77. 1. that “when it is necessary to address a military necessity or maintain public security and order through the mobilization of military forces in time of war, armed conflict or national emergency Similarly, the president may proclaim martial law as prescribed by law.”
The South Korean National Assembly has had time to vote in favor of lifting the martial law decreed by the South Korean president, Yoon Suk-yeol, in an extraordinary plenary session convened shortly after the president announced this exceptional measure. In the plenary session, the opposition forces that dominate the chamber approved with 190 votes in favor the revocation of martial law, which according to the South Korean Constitution obliges the president to withdraw that measure.
Martial law in practice means the paralysis of parliamentary activity. But not only is political activity paralyzed at the headquarters of the National Assembly, but the political activity of citizens is also paralyzed, equivalent to an effective war situation. All political activities are prohibited in South Korea after the imposition of martial law, all media become subject to government surveillance.
At the same time, they remain strictly all political activities prohibited in any areain local councils, city councils or political parties and neighborhood associations, as well as meetings and demonstrations of any kind.
All media and publications will be subject to the control of the martial law commandin the practice of military commands. Following the announcement by the president of South Korea, Yoon Suk-yeol, On television, protesters have gone to Parliament, already closed and controlled by the Army. Some helicopters have landed on the roof of the Parliament building in Seoul to expel parliamentarians.
Martial law involves the appointment of a commanding general. In this case, the head of the Joint Chiefs of Staff (JCS), Park An-su, has been appointed. In turn, the Minister of Defense, Kim Yong-hyun, has ordered strict surveillance of the Army to avoid a coup d’état and for the President of the Government to continue taking charge of decisions.
