The must present within 90 days a study on the infrastructure works that it must finance to offset the “debt” it owes due to oil royalties.
The deadline was requested by the government of Paraná from minister Flávio Dino, of the (Supreme Federal Court), rapporteur of the historic action that involves a review of the maritime limits between Paraná and Santa Catarina.
In a decision signed this Tuesday (3), Dino authorized the deadline and determined that, at the end of it, the states present the final agreement on how they will compensate Santa Catarina, harmed due to errors in maritime boundaries.
Oil fields were mistakenly considered to belong to Paraná since the 1980s, which meant that Santa Catarina was left without the royalties generated from their exploration over the years.
The error in currencies was already recognized by the STF in 2020 and with the help of IBGE, but the volume of royalty resources owed to SC.
On November 23rd, during the 12th meeting of the (South and Southeast Integration Consortium), in Florianópolis, the governments of Paraná and Santa Catarina announced the design of an agreement in which a value of R$300 million was reached.
Paraná would pay SC with infrastructure works that would benefit both. According to governors Jorginho Mello (PL), from Santa Catarina, and Ratinho Junior (PSD), from Paraná, the idea is to “potentiate integrated regional development”. Details of the agreement have not yet been released.
São Paulo understands that it does not owe royalties to southerners. In a note to the Panel this Wednesday (4), the Attorney General of the State of São Paulo said that the new maritime limits established by the STF “do not cover any of the fields currently belonging to São Paulo”.
“In the new configuration, São Paulo not only maintains its fields, but will also have exclusivity over the Tubarão field (currently belonging to Paraná), and also assumes, in sharing with Santa Catarina, the Estrela do Mar field (currently also of Paraná)”, he informed.
PGE did not explain whether the state of SP itself, given the new currency, would be entitled to claim past royalties.
