Minister Dias Toffoli, of the (Supreme Federal Court), stated this Wednesday (4) that freedom of expression is not an absolute right. The magistrate cited the case of the military police officer who was caught in the Cidade Ademar region, in the south of the capital, after being chased.
“Can we understand that what that police officer did in São Paulo, on the bridge, which since yesterday has been repeated on Brazilian television, on the news, is freedom of expression? Does freedom of expression encompass any expression?”, he stated.
The minister made the comment during his vote in the Marco Civil case, which has been under trial in court since last week.
In another example he gave, he cited cases of domestic violence. “A husband who beats his wife has and still goes in front of the judge and says ‘doctor, I don’t beat a woman. That’s mine’, does he have freedom? If we take the absolute to freedom of expression, everything is permitted,” he said. .
According to Toffoli, society lives in an environment of digital violence and the current legislation on platform liability grants them immunity. Although he has not yet completed his vote, he said that the situation is unconstitutional.
