The group of lawyers and academics Prerrogativas, which turns ten years old in 2014, will pay homage to First Lady Rosângela Silva, at a year-end party, this Friday (6), at a time when the collective is priority is given to punishing those suspected of coup plotting and faces controversy over the actions of , the (Supreme Federal Court).
Created out of opposition to the methods, considered “arbitrary excesses”, Prerogativas today has around 40 members with positions in the government (), who confirmed their presence at the party, in São Paulo.
It was in, that former rivals Lula and () appeared in public together for the first time as they approached the formation of the presidential ticket the following year.
This year, instead of the celebration at the Figueira Rubaiyat restaurant, there will be shows by Maria Rita and Ivo Meirelles for around 750 guests. Also on Friday, in Brasília, there will be a PT celebration dinner, which should cost other absences from the Prerogativas party. On the other hand, the deputy (Republicanos-PB), likely president of the Chamber from 2025, and ministers Cida Gonçalves (Women) and Margareth Menezes (Culture), as well as left-wing deputies, confirmed their presence.
The choice to honor Janja, according to members of Prerogativas, was unanimous and is mainly due to the first lady’s participation in the Global Compact, held in September, in New York, in which she demanded action from the private sector against the climate crisis.
“Janja has guided the government and the country on issues dear to the progressive field, such as feminism, sustainability. She has worked to build a more supportive and representative Justice system”, says lawyer Marco Aurélio de Carvalho, coordinator of Prerogativas.
According to Carvalho, Prerogativas’ effort is currently to ensure that there is no amnesty on January 8th.
“We have expressed ourselves emphatically so that the episodes [golpistas] subsequent and even antecedents are not trivialized”, says the lawyer, who was even considered to take on two ministries, but maintains his work in the private sector.
According to members of the group, the idea is to build a kind of permanent observatory to defend democracy and institutions.
In this sense, during Lava Jato, the former judge’s actions were challenged by Prerogativas, which saw a violation of fundamental rights and guarantees and judicial activism. Now, according to members, there is, but they admit that the performance is more discreet.
At the forefront of actions that target () and attacks on democracy, Moraes has acted as a judge and character of his own decisions. showed that the minister acted outside the rite in the fake news investigation, adopting attitudes that, in a normal process, are the responsibility of (the body that investigates) and the Attorney General’s Office (the body that makes the accusations).
This year, although one of the group’s lawyers, Alberto Zacharias Toron, had a confrontation with Moraes, the group’s assessment is that the minister is the target of those who attack democracy and, therefore, the strategy must be to preserve it. The reading is that Moraes and the STF lack the defense made by the progressive camp, where Prerogativas is located.
In general, when asked by SheetCarvalho states that the group works against the politicization of the Judiciary and the judicialization of politics. “I have said that each Power needs to return to its own box, so that we can reestablish democratic normality and independence between the Powers.”
Five Lula ministers are part of Prerogativas — (Finance), Jorge Messias (AGU), Vinícius de Carvalho (CGU), (Racial Equality) and Paulo Teixeira (Agrarian Development).
Other names from the group that make up the government are Fabiano Silva dos Santos, president of Correios; Manoel Carlos de Almeida Neto, executive secretary of ; Manoel Caetano, president of the Public Ethics Commission; Jean Uema, National Secretary of Justice, among others.
A second objective of Prerogativas is to defend an inclusive, diverse and representative Justice system, with a greater presence of women, black people and progressives — an agenda in which, according to the group’s understanding, Janja’s performance stands out.
The support of Prerogativas has been disputed by those who want to occupy vacancies in the courts. Recently, the group appointed her as a judge at the Federal Regional Court of the 3rd Region.
There are also nominees from the group of lawyers in the Electoral Court, the TST (Superior Labor Court) and the (Superior Court of Justice).
