The Court of Justice of Acre (TJAC) followed the understanding of the Court of Justice of São Paulo – the largest state court in the country – regarding the PEC of the spending cut package presented by the Lula government and sent to Congress this week.
According to Estadão, the proposal “generated a chain reaction in the Judiciary”. “The text compromises established rights of the national judiciary and threatens institutional stability”, assesses the TJ, which points out a “setback”.
The SP Court predicts that, if the proposal is approved, there will be an “exodus of magistrates” in courts across Brazil with “negative impacts on public coffers”.
“The massive departure of magistrates will increase the congestion of cases, with enormous losses to the provision of services to society and an inevitable shake of confidence in the Justice system”, emphasizes the São Paulo Court of Justice, presided over by judge Fernando Torres Garcia.
The TJ-SP estimates that the proposal could cause a cost of R$250 million per year to replace vacant positions that “will inevitably come” due to serial retirements.
Estadão highlighted that TJAC sang the demonstration of the São Paulo Court. In a note, judge Regina Ferrari spoke about the case and highlighted that around 40% of judges already have the necessary requirements for retirement and can, due to the PEC, “opt for immediate retirement, which would imply the need for holding new public tenders to replace staff, resulting in even higher costs to the Treasury, which contradicts the alleged fiscal objective of the measure”.
“Without an adequate functional framework, the Judiciary may face major obstacles in continuing to reduce the processing time of cases, causing harm to society and the provision of judicial services, compromising confidence in the Justice System”, added the president of the TJAC.
The report also points out that “the account of the TJ of Acre has already been the subject of a statement from the Council of Presidents of the Courts of Justice of Brazil, the Permanent College of Presidents of the Courts of Military Justice, the College of Presidents of the Electoral Courts of Brazil, the College of Presidents and Inspectors of the Regional Labor Courts and the Federal Regional Courts of the six Regions of Federal Justice”.
“This situation directly impacts society, which may face even more delays in resolving disputes and difficulties in accessing justice. The procedural congestion, aggravated by an insufficient number of magistrates, hinders the fulfillment of citizens’ demands, weakening confidence in the judicial system and widening inequalities in access to rights”, says an excerpt from a demonstration released this Wednesday (4) by Council of Presidents of the Courts of Justice of Brazil.
The courts’ reaction is related to the fact that the PEC of the cost-cutting package provides for changes in the remuneration ceiling, directly affecting the payment of compensation amounts to members of the Judiciary and the Public Ministry. As shown by Estadão, the PEC foresees changes to the public service remuneration ceiling, to combat the so-called “super salaries”.
In the case of the Judiciary, the impact occurs in the pennuricalhos. The government’s proposal is that some benefits, such as housing allowance and bonuses for those who work in more than one district, be restricted to exceptional situations.
