The São Paulo Court of Justice denied, this Thursday (Dec 12, 2024), the appeal of , which sought to prevent the vote in the Corinthians Deliberative Council on his dismissal from the presidency. THE Poder360 had access to the process. Here is the document (PDF – 1.2 MB).

The decision annulled the injunction (provisional decision) granted to Melo on December 2, when the vote was about to take place.

Romeu Tuma Júnior, president of the Deliberative Council, had filed an internal appeal, but the appeal was not analyzed, as judge Clara Maria Araújo Xavier chose to judge directly the merits of the case, due to the seriousness of the situation. The decision was taken together with 2 other judges from the collegiate.

Unanimously, with a score of 3-0, the Court clarified that there was no violation of Corinthians’ statutes. According to the decision, all deadlines and procedures were duly met, and Augusto Melo’s right to defense was assured. However, the Court noted that Melo chose to only make “considerations” at the club’s Ethics Committee, instead of presenting a formal defense when summoned.

With the decision of the Court of Justice, the sentence of judge Erasmo Samuel Tozetto, of the 8th Regional Forum, in Tatuapé, of December 2, was maintained. At the time, the magistrate rejected Augusto Melo’s request, arguing that the dismissal of association administrators is an internal matter.

The judge concluded that the Deliberative Council acted in accordance with the club’s internal rules and laws throughout the process.

Now, Augusto Melo can only try to reverse the situation by appealing to the STF (Supreme Federal Court).
