The Public Ministry of Goiás took legal action against 251 companies that operate in sports games and online casinos with fixed bets, known as bets.
The Prosecutor’s Office asks that platforms be obliged to insert, on their internet pages, “clear and precise warnings and warnings about the dangerousness and harmfulness of the product/service provision”, in a space of at least 20% of the main screen and in all game sections/modalities.
A period of 15 days must be stipulated for this measure, under penalty of suspension of internet activity, in addition to advertising the product on television or any other means.
The ACP (public civil action) includes a request for precautionary measure (provisional decision), with the purpose of anticipating the effects of a possible ruling in favor of the MP. ACP targets are all accredited with the Ministry of Finance, through the Secretariat of Prizes and Bets.
The MP from Goiás also wants the Court to order bets to disclose on websites, through pop-ups (windows that open in the internet browser), the message “gambling can cause gambling, disorders, addictions, over-indebtedness, in addition to of adverse consequences.”
According to prosecutor Élvio Vicente da Silva, the civil action aims to create a safer and more responsible environment for consumers. “It is an essential milestone to protect the dignity and financial and emotional health of the population,” he said.
Among other requests, the prosecutor also proposes that the Court oblige bets to provide “complete transparency” to consumers about the amounts collected from bets, with an indication of the individual movement of each modality, and to keep, in a digital file, for a minimum period of five years, the entire history of the relationship between the bettor and the company.
