Action filed by Sâmia Bomfim, from PSOL, argues that the PL parliamentarian attacked the integrity of the electoral process; trial will only be completed in 2025, and Zambelli will be able to appeal to the TSE
The Regional Electoral Court of São Paulo () has a majority to revoke the mandate of the federal deputy (PL-SP). The decision was based on allegations of misuse of the media and abuse of political power during the 2022 elections. The trial, which has a score of 4 to 0 against the parliamentarian, was interrupted after a request for review and will resume on next year, after the Judiciary recess. Zambelli may appeal to the Superior Electoral Court ().
The action that resulted in the impeachment was filed by the deputy (PSOL-SP), who denounced the creation of a “misinformation ecosystem” by Zambelli. According to Bomfim, the deputy had propagated false information that questioned the legitimacy of the electoral process. The case’s rapporteur, Encinas Manfré, highlighted that Zambelli acted consciously to spread fraudulent information and incite hostility against the electoral system and the Judiciary.
Sâmia’s lawyer, Luiz Paulo Viveiros de Castro, reinforced that Zambelli attacked the integrity of the electoral process, in addition to criticizing ministers from the TSE and STF. On the other hand, the defense of the PL deputy, led by Flavia Cardoso Campos Guth, argued that she only exercised her right to freedom of expression and that there is no concrete evidence to support the accusations.
Electoral prosecutor Paulo Taubemblatt spoke in favor of the conviction, stating that Zambelli participated in “scary post-election plots” and violated the principle of equality between candidates by disseminating misleading information. In response to the decision, Zambelli declared in a statement that “nothing has changed” and that he is confident in the possibility of reversing the result.
