He Supreme Court of Argentina decided this Monday to dismiss an appeal presented by the former president Cristina Fernandez (2007-2015) in a case in which she is accused of money laundering and admission of gifts and for which it must now go to oral and public trial.
The ruling, to which EFE had access, rejected the former president’s appeal and made the sentence of the Federal Court of Criminal Cassation finalwhich in November 2023 had annulled Fernández’s dismissal in the case known as Hotesur-Los Sauces.
The cause is named of two companies related to the Fernández family and her husband and predecessor, the late former president Néstor Kirchner (2003-2007), and investigates alleged maneuvers through those firms through which money laundering from the awarding of public works would have been incurred.
For this reason – which initially were two and ended up being unified – Fernández was prosecuted for the alleged crime of money launderingbut it was later dismissed in November 2021, before the start of the oral trial.
He appeal rejected today by the Supreme Court It had also been requested by the former president’s son, Máximo Kirchner, accused of money laundering and illicit association, and by two other defendants.
“The defense has failed to demonstrate a current, concrete and real grievance, different from the mere fact that implies submission to the criminal proceedings of the appellants herewhich is why the appealed sentence does not constitute a final sentence nor is it comparable to such, and no exceptional circumstance is verified that justifies the intervention of this Court,” said judges Horacio Rosatti, Carlos Rosenkrantz and Juan Carlos Maqueda in their opinion.
This decision comes less than two weeks after the Supreme Court will reject an appeal by the former president in a case in which she is accused of covering up the attack on the Argentine Israelite Mutual Association (AMIA) for signing a memorandum of understanding with Iran in 2013, and for which she must also go to an oral and public trial.
Last month, in addition, the Argentine Federal Court of Criminal Cassation confirmed the sentence of six years in prison and “perpetual disqualification from holding public office” against Fernández in a case known as ‘Vialidad’, in which irregularities in the concession were investigated. of 51 road works to the signatures of businessman Lázaro Báez during the governments of the former president and Néstor Kirchner.
