The Federal Court denied this Tuesday (17) a request for an injunction to extend the agreement that transferred the management of the Port of Itajaí to the municipality of Santa Catarina and which comes into force on December 31st. With this, an obstacle to the federalization of the port was removed.
According to the decision of judge Moser Vhoss, of the 2nd local Federal Court, it would be necessary to demonstrate clear unconstitutionality or illegality for the Judiciary to interfere in the natural evolution of port management according to the agreement signed. He stated that it is not enough to “conjecture negative effects on the region that are only foreseen, but that cannot be assured with a satisfactory level of certainty”.
In the order, the judge considered that the parties involved can establish direct contact, without the need for judicial intervention, to confirm or change the resolution of the agreement.
The action requested the extension of the agreement for at least 12 months and the suspension of any administrative act relating to the federalization of the Port of Itajaí, in addition to the creation and installation of a commission or working group, with the participation of the parties, the municipality and of port workers.
The Minister of Ports and Airports, Silvio Costa Filho, said at the beginning of the month that the federalization proposal is being finalized and will be presented to President Lula for a joint decision.
