The minister Alexandre de Moraesfrom the Federal Supreme Court (STF), ordered the Rio de Janeiro Penitentiary Administration Secretariat (SEAP) to present updated data on the prison conduct of the former federal deputy Daniel Silveira (no party-RJ).
The decision, published on Monday (16), also requires a statement from the Attorney General’s Office (PGR) before Moraes evaluates the request for parole made by the former parliamentarian’s defense.
Silveira is serving a sentence of 8 years and 9 months in prison, imposed by the STF in 2022, for threatening the Democratic Rule of Law and coercing the progress of the process.
Initially arrested on February 2, 2023, shortly after the end of his term, he managed to progress to the semi-open regime in October.
He is currently detained at the Marco Aurélio Vargas Tavares de Mattos Agricultural Colony, located in Magé, Rio de Janeiro, where he works on a project to plant trees native to the Atlantic Forest.
Despite this progression, the defense seeks to grant conditional release so that Silveira can serve the remainder of his sentence at his home, in Petrópolis, in the mountainous region of Rio. According to lawyer Paulo Faria, the former deputy would have already completed 55 days beyond necessary to apply for parole, according to the most recent request filed last Friday (13).

In Monday’s decision, Moraes approved the remission of 98 days of the sentence, corresponding to activities carried out by Silveira, such as work, studies and reading. “I approve, for redemption purposes, the study, work and reading hours presented by the sentenced person, in a total of 98 days, which must be redeemed from his sentence”, noted the minister in the order.
In addition to recognizing the convict’s efforts while serving his sentence, the magistrate ordered the issuance of a new certificate updating the calculations, considering the days deducted, and ordered the sentenced to be informed. The final assessment of the freedom request will depend on the opinion of the PGR and the data provided by SEAP on Silveira’s prison conduct.
Daniel Silveira’s sentence was pardoned through a pardon signed by former president Jair Bolsonaro (PL). However, the STF annulled the pardon, maintaining the original conviction.
