STJ closes Lava Jato actions against José Dirceu – 12/17/2024 – Power

The Fifth Panel of the (Superior Court of Justice) closed this Wednesday (17) proceedings against the former minister, after the minister of the (Supreme Federal Court) had.

After Gilmar’s decision, the other courts were responsible for analyzing whether the cases could still be restarted in court.

Three cases were judged involving the former chief minister of the Civil House from Lula’s first term (), all under the report of Minister Daniela Teixeira.

In two cases, there was recognition of prescription (when the deadline for the person to be prosecuted is exceeded).

In them, Dirceu had already been convicted of the crimes of money laundering.

In a third case, in which the former minister had already been acquitted in the first instance, the acts of the former judge, now a senator for -PR, were annulled.

These actions were part of what were still pending before the STJ.

When starting the trial, the rapporteur stated that the guidelines that would guide her votes in the cases were the decisions taken by Gilmar and by the STF minister in processes related to the operation.

“It is well known that, currently, the Federal Supreme Court has already taken a clear position regarding a relevant number of theses that directly affect the judgment of the processes of this operation”, said the minister when starting the trial.

According to her, her decisions would pay special attention to what was decided in the Supreme Court regarding which processes should be sent to the Electoral Court and in which there were suspicions regarding authorities who worked on them — as is the case of Moro.

In the series of trials, the ministers also decided to maintain the revocation of the use of an electronic ankle bracelet by the former governor of Rio de Janeiro Sérgio Cabral, the main target of the Rio de Janeiro branch of Lava Jato.

They denied, however, a request from the former minister’s defense to unlock part of his assets that had been blocked by the courts — worth R$35 million.

In addition to Daniela Teixeira, the group includes ministers Reynaldo Soares da Fonseca, Ribeiro Dantas, Joel Ilan Paciornik and Messod Azulay Neto. The Fifth Panel is responsible for cases in the criminal area of ​​the court.
