Rapporteur proposes end of Dpvat in government cuts project

Átila Lira states that the revocation was discussed with the Ministry of Finance; recreation of insurance was approved by Congress in May

The rapporteur of one of the projects in the government’s spending cut package, deputy Átila Lira (PP-PI), proposed the end of the recently created Spvat (Mandatory Insurance for the Protection of Victims of Traffic Accidents) in his opinion. The text must be voted on this Tuesday night (Dec 17, 2024). Here’s the of the report (PDF – 181 kB).

The text proposes blocking and contingency amendments made by congressmen up to the same proportion as the blocks applied to other non-mandatory government expenses, that is, up to 15% of the total value.

Reformulating the old Dpvat (Personal Injury by Land Motor Vehicles) was one of the government’s priorities at the beginning of the 2024 semester. Luiz Inácio Lula da Silva (PT) sanctioned the text on May 17th.

In his opinion, Átila stated that the repeal of the law that recreated the insurance was discussed with the Ministry of Finance. “Although meritorious, the measure met with resistance in civil society”declared the deputy.

The annual insurance amount has not been defined to date. At the time of approval in Congress, the leader of the Government in the Senate, (PT-BA), said that it should be around R$50 to R$60 per year.

The Dpvat was discontinued in 2020. The former president (PL) signed an MP (Provisional Measure) that extinguished the insurance in 2019, but Congress did not approve the proposal and the text expired. Only in the following year did the CNSP (National Council of Private Insurance) abolish insurance payments. The new rule came into effect in 2021.
